UPDATE PUTUSAN PENGADILAN TINGGI BANTEN

Pengadilan Tinggi Banten melalui Putusan No. 160/Pid/2025/PT BTN mengurangi hukuman Charlie Chandra dari 4 tahun menjadi 1 tahun penjara.
Perkara ini bermula dari tuduhan “turut serta membuat surat palsu”, yaitu formulir pengajuan balik nama warisan (Lampiran 13 BPN) — sebuah dokumen administrasi yang sebenarnya diisi oleh notaris, bukan oleh Charlie sendiri.

Dalam persidangan terungkap, Putusan Pengadilan 726/Pdt/1998/PT.Bdg menegaskan AJB atas nama Sumita Chandra sah, mengikat, dan melindungi haknya sebagai pembeli beritikad baik. Hingga kini, tidak ada putusan yang membatalkan AJB maupun SHM No. 5/Lemo atas nama Sumita Chandra.

The case of Charlie Chandra is a clear example of how land and legal mafia operate behind the mega project PIK 2 in Tangerang, Indonesia. The Chandra family owned 8.7 hectares of land under Certificate of Ownership (SHM) No. 5/Lemo, registered in the name of the late Sumita Chandra since 1988, based on a legally valid Deed of Sale and Purchase (AJB) recognized by multiple court decisions, including Bandung High Court Decision No. 726/Pdt/1998. For decades, the family legally controlled and utilized the land while paying land and building taxes (PBB) regularly. However, in 2013, tenants were unlawfully evicted by thugs, and the land was forcibly occupied by PT Mandiri Bangun Makmur, a subsidiary of Agung Sedayu Group (PIK 2), without any legal basis. Ironically, when Charlie Chandra, as the rightful heir, attempted to process the inheritance title transfer at the Land Office (BPN), he was criminalized under false charges of forging BPN Form 13. The clause stating that the land was “not under dispute and under physical control” legally applies to the rightful SHM holder, not to an illegal occupier. Court proceedings even confirmed that PT MBM had no legal ownership basis, making their control an unlawful occupation. Despite this, Charlie was sentenced to 4 years in prison.
