  2. The certificate (SHM) remains registered in Charlie’s father’s name

  3. Land and Building Tax (PBB) paid from 1988–2023

  4. Inheritance tax paid in 2023

All land ownership lawsuits concerning this property have been won by the Charlie Chandra family up to the Supreme Court level and through Judicial Review.

Physical Possession:

For decades, this land was physically controlled and managed by the Charlie Chandra family, until it was forcibly occupied without any legal basis.

  • 1988–2013 – used as fishponds and later leased by the Charlie Chandra family

  • 2013 – fishpond tenants were forcibly evicted by thugs. Since 2013, the Charlie Chandra family has no longer been able to access its own land

  • 2014 – the land was occupied by PT MBM (ASG)

Since that time, the Charlie Chandra family has lost access to land that remains legally owned by them.

What Is the Basis of PIK-2’s Claim Over This Land?

  1. Relying on location permits and powers of attorney, rather than proof of land ownership
  2. Using an old criminal ruling 596/Pid.S/1993/PN.TNG that has been set aside by higher civil court rulings
  3. 726/Pdt/1998/PT.Bdg.
  4. The issuance of SHGB 502/Lemo in July 2023 on land that has been certified (SHM No. 5/Lemo in the name of Sumita Chandra) since 1982.
